Agreement to Terms

By downloading, installing, or using the Kine app ("App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not use the App.

Description of Service

Kine is an athletic performance testing and analysis application designed for coaches, trainers, and sports professionals. The App allows you to:

• Collect and analyze athletic performance data
• Track athlete progress over time
• Generate performance reports and metrics

User Responsibilities

As a user of the App, you agree to:

• Provide accurate information when creating accounts or profiles
• Obtain proper consent from athletes before collecting their data
• Use the App in compliance with applicable laws and regulations
• Maintain the security of your device and any exported data
• Not use the App for any unlawful purpose

You are solely responsible for:

• The accuracy of data you enter into the App
• Obtaining and documenting consent from athletes (see Privacy Policy)
• Compliance with data protection laws in your jurisdiction
• Safeguarding any exported data files

Data and Privacy

Your use of the App is also governed by our Privacy Policy. Key points:

• Personal data is stored locally on your device
• You control all athlete data as the Data Controller
• Anonymous analytics are optional and off by default
• You can export or delete data at any time

Intellectual Property

The App, including its design, features, and content, is owned by Kine and protected by intellectual property laws. You may not:

• Copy, modify, or distribute the App
• Reverse engineer or attempt to extract source code
• Remove any proprietary notices from the App
• Use the App's branding without permission

Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, express or implied. We do not warrant that:

• The App will meet your specific requirements
• The App will be uninterrupted or error-free
• Results obtained from the App will be accurate
• Any errors in the App will be corrected

Athletic performance metrics are for informational purposes only and should not replace professional judgment.

Limitation of Liability

To the maximum extent permitted by law, Kine shall not be liable for:

• Any indirect, incidental, or consequential damages
• Loss of data, revenue, or profits
• Injuries resulting from training decisions based on App data
• Any damages exceeding the amount you paid for the App

Indemnification

You agree to indemnify and hold harmless Kine from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third party rights
• Data you collect through the App

Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users or third parties
• Is harmful to us

Upon termination, your right to use the App ceases immediately. Data stored locally on your device remains yours.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App. Continued use after changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by the laws of Poland. Any disputes shall be resolved in the courts of Poland.
